Ciba must remove more than 30,000 drums from landfill

TOMS RIVER -- The state will consider suing Ciba Specialty Chemicals Corp. if the company does not agree to remove more than 30,000 drums from a lined landfill on its property, Department of Environmental Protection Commissioner Bradley M. Campbell said today.

In a letter sent to Douglas J. Hefferin, vice president for Environment, Health and Safety at Ciba Specialty Chemicals, Campbell said he has grown increasingly concerned about possible threats to the environment and public health if the landfill remains open.

Campbell's letter represents a major victory for Dover Township officials, who have for years called on Ciba to remove all drums from its property off Route 37 West and Oak Ridge Parkway.

More than 47,000 drums of waste were removed in the past year from an unlined landfill on the site, but Ciba officials have continually maintained that the lined landfill, which is overseen by DEP, is safe and is not leaking.

Ciba Specialty Chemicals spokeswoman Donna Jakubowski reiterated the company's position today, saying the township's contention that the lined landfill is leaking is based on old data, and does not take into account improvements that have been made to the landfill in the past 15 years.
